Do I need to file an application in every country?
While trademarks are mostly registered on a country by country basis, there are a number of mechanisms to file one application for numerous countries. While your trademark attorney can give you more specifics on this, 15 cooperating countries of Europe (excluding Switzerland) allow for the filing of one Community Trade Mark (“CTM”) Application to seek a registration in all 15 countries. Also, companies that are resident in one of the countries that are signatories to the Madrid Treaty (which does not include the United States) can file one application for protection in over 25 countries.
